These Terms & Conditions (“Terms”) are a binding agreement between you and Upstate Structural Repair LLC (“Upstate Structural Repair,” “we,” “us,” “our”). They govern your use of our pages on unitedstructuralrepair.com (the “Site”) and the communications you may receive from us. We provide foundation and structural repair services in Upstate South Carolina. By using the Site, submitting a form, or checking a consent box on one of our forms, you accept these Terms. If you do not agree, do not use the Site or submit a form. The Site is intended for individuals 18 years of age or older.
1. Communications Consent (Calls, Texts, and Emails)
When you submit a form on our Site and check the consent box, you give Upstate Structural Repair LLC your prior express written consent to contact you by phone call, text message (SMS/MMS), and email at the phone number and email address you provided. These communications may include:
- Responses to your estimate or service request
- Appointment scheduling, confirmations, and reminders
- Updates about your project
- Occasional marketing messages, promotions, and service reminders
Calls and texts may be made or sent using automated telephone dialing technology or prerecorded or artificial voice messages. This consent constitutes your signature and prior express written consent under the federal Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, and South Carolina’s telemarketing and do-not-call laws. It applies even if the number you provided is on a federal, state, or internal do-not-call list. Your consent extends to service providers contacting you on our behalf.
Consent is not a condition of purchase. You can get an estimate or hire us without agreeing to receive marketing communications. Just call us instead: 864-527-6330.
2. Text Message (SMS) Program Terms
- Program description: Upstate Structural Repair LLC sends service-related and occasional promotional text messages to customers and prospective customers who opt in through our website forms or by other written consent.
- Message frequency: Varies based on your project and our promotions.
- Cost: Message and data rates may apply according to your mobile carrier plan. We do not charge for texts, but your carrier’s standard rates apply.
- Opt out: Reply STOP to any text message to cancel. After you send STOP, we will send one final message confirming you have been unsubscribed. No further messages will be sent unless you opt in again.

- Carriers: Supported carriers include all major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
3. Opting Out of Other Communications
- Email: Click the unsubscribe link in any marketing email, or email us at with “Unsubscribe” in the subject line.
- Phone calls: Tell us during any call that you no longer wish to receive calls, or contact us at or 864-527-6330 and ask to be placed on our do-not-call list.
Opting out of marketing communications does not affect messages we need to send about an active project or scheduled appointment.
4. Estimates and Services
Information on this Site, including any pricing discussion, is for general information only and is not a binding offer. Estimates become binding only when set out in a written contract signed by both you and Upstate Structural Repair LLC. We serve customers in South Carolina; service availability and offerings vary by location, and nothing on this Site is an offer to perform work outside South Carolina or in any location where we are not licensed or able to perform it. The company responsible for your project is the company named in your written estimate or service contract.
5. Accuracy of Information You Provide
You agree that the contact information you submit is your own and is accurate. If you provide a phone number or email address that does not belong to you, you are responsible for any resulting claims. You agree to notify us promptly at or 864-527-6330 if you change, deactivate, or give up the phone number you provided, and you agree that we are not liable for communications sent to a number you no longer hold if you have not notified us.
6. Intellectual Property
All content on this Site, including text, photos, videos, graphics, and logos, belongs to Upstate Structural Repair LLC or its licensors and may not be copied or reused without our written permission.
7. Disclaimer and Limitation of Liability
The Site is provided “as is” without warranties of any kind. To the fullest extent permitted by law, Upstate Structural Repair LLC is not liable for indirect, incidental, or consequential damages arising from your use of the Site. Nothing in these Terms limits warranties or liability set out in a signed service contract, which governs any work we perform for you.
8. Privacy
Our explains how we collect and use your information. We do not sell your personal information. Mobile opt-in data and consent are not shared with third parties or affiliates for their marketing purposes.
9. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top shows the current version. Continued use of the Site after changes means you accept the updated Terms.
10. Dispute Resolution: Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.
Informal resolution first. Before starting arbitration, you agree to first contact us at or by mail at 846 N Highway 25 Bypass, Greenville, SC 29687 with a written description of your dispute and give us 60 days to resolve it with you informally.
Agreement to arbitrate. Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any communication from us (including any claim under the Telephone Consumer Protection Act or any state telemarketing, do-not-call, or consumer protection law) that is not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this section. The arbitrator has exclusive authority to resolve any dispute about the interpretation, applicability, or enforceability of this agreement to arbitrate. Arbitration will take place in the county where you reside or another location we mutually agree on, and may be conducted by phone, video, or written submissions.
Small claims exception. Either party may instead bring an individual claim in small claims court in a county where it may properly be brought.
Class action waiver. You and Upstate Structural Repair LLC each agree that any proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. The arbitrator may not consolidate more than one person’s claims. If this class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) must proceed in court, and the waiver remains in force for all other claims.
Jury trial waiver. To the extent any dispute proceeds in court rather than arbitration, you and Upstate Structural Repair LLC each waive the right to a trial by jury.
Your right to opt out. You may opt out of this arbitration agreement by mailing a signed written notice to 846 N Highway 25 Bypass, Greenville, SC 29687 within 30 days of first accepting these Terms, stating your name, address, phone number, and your intent to opt out of arbitration. Opting out of arbitration does not affect any other part of these Terms.
Signed contracts. If you sign a service contract with us that contains its own dispute resolution terms, those terms control for disputes about that work.
11. Governing Law and Venue
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs Section 10. Subject to Section 10, any dispute that proceeds in court must be brought exclusively in the state or federal courts located in Greenville County, South Carolina, and you consent to personal jurisdiction and venue there.
12. General Provisions
- Parties. These Terms are solely between you and Upstate Structural Repair LLC. No other person or company is a party to, or responsible for, these Terms or our services.
- Entire agreement. These Terms, together with our Privacy Policy and any signed service contract, are the entire agreement between you and Upstate Structural Repair LLC regarding the Site and our communications, and supersede any prior understandings on those subjects.
- Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions remain in full force.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later. Any waiver must be in writing and signed by us.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
- Survival. Sections 1 through 3 (as to communications already consented to), and Sections 6, 7, 10, 11, and 12 survive any termination of these Terms.
